3. Subscriptions, Billing, and Renewals

• Services are provided under the subscription plan you select.
• Fees are billed in advance and are non-refundable except as required by law or agreed in writing.
• Annual pricing reflects published savings compared with monthly billing.
• You authorize us and our payment processors to charge applicable fees, taxes, and renewals.

4. Permitted Use

You agree not to:

• Use the service for unlawful, fraudulent, or harmful activity.
• Attempt unauthorized access to accounts, systems, or data.

FieldCommand and related technology, software, and content are owned by us or our licensors and protected by intellectual property laws. No ownership rights are transferred to you.

8. Service Changes and Availability

We may update, modify, or discontinue features from time to time. We aim for reliable uptime but do not guarantee uninterrupted or error-free service.

9. Termination

• You may stop using the service at any time.
• We may suspend or terminate access for material breach, unlawful use, or security risk.
• On termination, rights to access the service end except as otherwise required by law or agreement.

10. Disclaimers

The service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, FieldCommand will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising from your use of the service.

12. Indemnification

You agree to indemnify and hold harmless FieldCommand from claims, damages, liabilities, and costs arising from your use of the service, Customer Data, or violation of these Terms.

13. Governing Law

These Terms are governed by applicable laws of the United States and the State of Colorado, without regard to conflict of law principles, unless otherwise required by law.
